Custody
Whether you are arrested by way of probable cause, a warrant, or turning yourself in, you will first and foremost be taken into custody. It is important at this point that you know your Miranda rights. These rights include the right to remain silent and the right to consult with a lawyer. Once taken into custody, you may be questioned and your belongings will be taken and searched.
Booking
Next, you will be booked. You will provide basic information such as your name, address, and date of birth. You will also be fingerprinted and photographed. The prosecutor will then make a decision on what charges will be filed.
Arraignment
Following booking, you will appear in court. Your charges will be read and you will decide how to plead. At this point, you may be able to leave custody by posting bail. This process involves paying money to the court with a promise that you will return for your future trial date.
