
The use of “uniform trendy law” was an instrument to realize social change, and precedence to the function of the state within the economy and the event of internal markets. On this view, an individual who accepts advantages from another individual thereby incurs a duty of gratitude in direction of the benefactor. And the only plausible way to discharge this obligation in direction of the government is to obey its laws. Contemporary positivists, for essentially the most part, settle for the idea that positivism is inconsistent with an obligation to obey regulation qua legislation (examine Himma 1998), but argue that the mere status of a norm as law cannot give rise to any ethical obligation to obey that norm.
